These Terms of Service ("Agreement") constitute a legally binding contract between Vaixus Technologies, a technical consulting entity registered and operating from Tiruppur, Tamil Nadu, India ("Company", "we", "us", or "our"), and the business entity or individual ("Client", "you", or "your") accessing or purchasing our services.
By engaging our services — whether through a signed service order, invoice acceptance, or payment — you confirm that you have read, understood, and agree to be bound by these Terms in their entirety. If you are accepting these Terms on behalf of a company, you represent that you have the authority to bind that entity.
This Agreement governs all technical infrastructure and DNS consultation services provided by Vaixus Technologies, including but not limited to email authentication audits, DNS record configuration, DMARC/SPF/DKIM remediation, and postmaster monitoring engagements.
Vaixus Technologies provides B2B technical consulting services focused on email deliverability infrastructure, specifically:
- DNS Audit Services: Analysis of existing SPF, DKIM, and DMARC records; identification of misconfigurations, lookup overflows, and alignment failures.
- DNS Remediation Services: Direct modification of DNS records on behalf of the Client, with explicit Client authorization and access provisioning.
- Vendor Alignment: Configuration of third-party Email Service Providers (ESPs) to comply with DMARC alignment requirements.
- Policy Enforcement: Graduated implementation of DMARC enforcement policies from
p=nonethrough top=reject. - Postmaster Monitoring: Setup and baseline establishment of Google Postmaster Tools and DMARC aggregate reporting pipelines.
Specific deliverables, timelines, and access requirements for each engagement are detailed in the individual service order or proposal document provided to the Client prior to payment.
Vaixus Technologies acts solely as a technical advisor and executor of DNS infrastructure changes. We do not operate as an Email Service Provider, Internet Service Provider, domain registrar, or hosting company. Our services are limited to the technical configuration and remediation of email authentication protocols as directed and authorized by the Client.
The Company does not take ownership of, control over, or responsibility for the Client's domain name, DNS zone, sending infrastructure, or email programs. All changes made to DNS records by the Company are made under the Client's explicit authorization and remain the property and responsibility of the Client.
The Client acknowledges that email deliverability is influenced by numerous factors beyond DNS authentication configuration, including but not limited to: sending reputation, content quality, list hygiene, recipient engagement, and third-party spam filter decisions. Vaixus Technologies makes no guarantee of specific inbox placement rates or deliverability outcomes.
The Client is solely responsible for providing, in a timely manner, the access credentials and permissions required for service delivery. This includes:
- Domain Registrar Access: The Client must provide authenticated access (login credentials, API keys, or designated administrator access) to the domain registrar(s) hosting their DNS zone(s). Vaixus Technologies requires this access to implement DNS record changes. The Client is responsible for providing and revoking this access.
- ESP Platform Access: Read or write access to Email Service Provider dashboards (e.g., HubSpot, SendGrid, Outreach, Apollo, Lemlist) as required for DKIM key provisioning and vendor configuration.
- Google Postmaster / Reporting Platforms: Domain verification access for postmaster tool registration.
- Accurate Information: The Client is responsible for disclosing all active ESPs, sending subdomains, and bulk mailing infrastructure at the time of engagement. Failure to disclose active sending infrastructure may result in incomplete remediation.
Vaixus Technologies shall not be held liable for service delays or incomplete remediation resulting from the Client's failure to provide necessary access in a timely manner. The Company reserves the right to pause or terminate the engagement if required access is withheld for more than five (5) business days after written request.
All service fees are payable in full prior to commencement of the engagement, unless otherwise agreed in writing. Accepted payment methods include Paddle (card processing) and international wire transfer. Invoices are issued in United States Dollars (USD) by Vaixus Technologies, Tiruppur, Tamil Nadu, India.
The Client is responsible for any applicable taxes, duties, or withholding taxes imposed by their jurisdiction. Vaixus Technologies will provide a formal invoice for all engagements. GST (Goods and Services Tax) may be applicable on services rendered to Indian-resident entities in accordance with Indian tax law.
All fees are strictly non-refundable once the audit and deployment process has commenced. For the complete refund policy, please refer to our Refund Policy.
Vaixus Technologies treats all Client infrastructure information as strictly confidential. We do not disclose Client domain configurations, DNS records, or ESP vendor relationships to any third party without explicit written consent, except as required by applicable law.
Access credentials provided by the Client are used solely for the purpose of executing the contracted services. Credentials are not stored beyond the engagement period and are destroyed upon project completion or Client request. For a full description of our data handling practices, please refer to our Privacy Policy.
All audit reports, remediation documentation, scripts, and technical deliverables produced by Vaixus Technologies for a Client engagement become the property of the Client upon receipt of full payment. The Company retains ownership of its proprietary methodologies, internal tooling, audit frameworks, and software systems used in producing deliverables.
The Client grants Vaixus Technologies a limited, non-exclusive license to access and modify the Client's DNS records solely for the purpose of completing the contracted engagement.
To the maximum extent permitted by applicable law, Vaixus Technologies' total liability to the Client for any claim arising out of or relating to these Terms or the Services shall not exceed the total fees paid by the Client in the three (3) months preceding the event giving rise to the claim.
In no event shall Vaixus Technologies be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to: loss of revenue, loss of business, loss of data, or reputational harm — even if the Company has been advised of the possibility of such damages.
Vaixus Technologies is not responsible for DNS propagation delays, ESP-side configuration changes, third-party platform outages, or Google/Yahoo policy changes that occur after delivery of the contracted services.
Vaixus Technologies warrants that services will be performed in a professional and workmanlike manner consistent with industry standards. All DNS configurations implemented by the Company will be technically correct at the time of implementation and consistent with RFC specifications and current Google/Yahoo bulk sender requirements.
THE COMPANY MAKES NO WARRANTY THAT THE SERVICES WILL RESULT IN ANY SPECIFIC INBOX PLACEMENT RATE, DELIVERABILITY SCORE, OR BUSINESS OUTCOME. Email deliverability is affected by factors outside the Company's control including but not limited to sending content, recipient behavior, third-party spam filter decisions, and the Client's ongoing email program management.
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Tiruppur, Tamil Nadu, India.
Before initiating formal legal proceedings, the parties agree to attempt resolution through good-faith negotiation for a period of not less than thirty (30) days.
Vaixus Technologies reserves the right to update these Terms at any time. Material changes will be communicated to active clients via the support email address on file.
